We operate oblivark.app - a cross-game guild and clan management platform for MMO and survival game communities.

1. Our Services

Oblivark provides guild, clan, and community management tools for online game groups, including planning, member management, applications, attendance, communication flows, and related operational features.

Our services are intended for lawful use by individuals, creators, administrators, and communities that manage game organizations. Availability of some features may depend on your account status, subscription tier, technical environment, or third-party platform integrations.

2. Intellectual Property Rights

Unless otherwise indicated, Oblivark and all related software, branding, interface elements, text, graphics, and platform materials are owned by us or licensed to us and are protected by applicable intellectual property laws.

  • You receive a limited, non-exclusive, revocable right to use the service in accordance with these terms.
  • You may not copy, sell, resell, reverse engineer, or exploit protected platform materials except as allowed by law.
  • Community names, logos, or content you upload remain subject to the rights you or their rightful owners hold.

3. User Representations

By using Oblivark, you represent that:

  • The information you provide is accurate, current, and not misleading.
  • You have legal capacity to agree to these terms or valid authorization to act on behalf of an organization.
  • Your use of the service will comply with applicable laws, platform rules, and third-party terms such as Discord rules where relevant.
  • You will not use the service for fraud, harassment, malware, or unlawful surveillance.

4. User Registration

Certain features require an account and may rely on third-party authentication services, including Discord sign-in.

You are responsible for keeping your login method, connected accounts, and devices secure. You are also responsible for activity that occurs under your account unless caused by our own failure to protect it.

5. Purchases and Payment

Paid features are processed through third-party payment and subscription infrastructure. You agree to provide valid payment details and authorize us and our providers to charge amounts due for the selected plan.

  • Prices may be listed exclusive or inclusive of tax depending on context.
  • We may correct obvious pricing, billing, or invoicing errors.
  • Failed payments may result in feature suspension, downgrade, or account restrictions until payment issues are resolved.

6. Subscriptions

Some Oblivark features are offered on a recurring subscription basis. Unless cancelled, subscriptions may renew automatically at the end of each billing cycle.

  • You may manage or cancel a subscription through the customer billing portal when available.
  • Cancellation usually takes effect at the end of the current paid period unless otherwise required by law.
  • Downgrades or cancellations may reduce access to paid features or usage allowances.

7. Right of Withdrawal (EU/France)

French Consumer Code - right of withdrawal rules, including Article L221-28

If you are a consumer in the European Union or France, you may generally benefit from a 14-day withdrawal right for distance contracts.

However, for digital content or digital services supplied before the end of that period, the withdrawal right may be lost once performance begins with your prior express consent and acknowledgment that the withdrawal right is waived where the law allows that result.

If immediate access to paid digital features is activated at your request, you may be asked to accept that the service starts before the withdrawal period expires.

8. Legal Compliance Warranty

French legal conformity warranty for digital content and digital services, including Articles L224-25-12 and following of the Consumer Code

Where French consumer law applies, Oblivark is expected to provide digital services that conform to the contract and to the objective criteria required by law.

If a qualifying consumer-facing digital service has a legal non-conformity, the consumer may have statutory remedies, which can include repair or correction, price reduction, or contract resolution in the cases allowed by law.

This section summarizes mandatory legal rights and does not reduce any protection granted by applicable consumer law.

9. Prohibited Activities

You may not use Oblivark to:

  • Violate laws, regulations, or third-party rights.
  • Upload malware, exploit vulnerabilities, or bypass security.
  • Harass, threaten, dox, impersonate, or abuse other users.
  • Scrape, mirror, or automate access to the service in an abusive manner.
  • Use the platform to coordinate unlawful conduct or distribute harmful or deceptive materials.

10. User Generated Contributions

You may submit or manage content through Oblivark, including guild descriptions, applications, schedules, rosters, comments, naming conventions, or other community data.

You remain responsible for the legality, accuracy, and rights clearance of the content you contribute or administer through the platform.

11. Contribution License

By submitting content through the service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, and process that content solely as needed to operate, secure, improve, and make available the service.

This license ends when your content is deleted from our active systems, subject to reasonable backup, legal retention, and operational needs.

12. Third-Party Websites and Content

Oblivark may interact with third-party services, links, community platforms, or embedded content. We do not control all third-party services and are not responsible for their terms, policies, availability, or content.

Your use of those services is governed by their own rules and contracts.

13. Services Management

We may manage the service to protect users and platform integrity.

  • We may monitor misuse, investigate complaints, and enforce policies.
  • We may remove content or restrict activity that poses legal, security, or operational risk.
  • We may update features, limits, or technical requirements over time.

14. Privacy Policy

Your use of Oblivark is also subject to our Privacy Policy, which explains how we collect, use, and protect personal data.

15. Term and Termination

These terms remain in effect while you use the service. We may suspend, restrict, or terminate access if you violate these terms, create risk for the platform, or if continued service is no longer feasible.

You may stop using the service at any time, and paid plan handling remains subject to the billing and refund rules described elsewhere in these terms.

16. Modifications and Interruptions

We may modify, suspend, or discontinue any part of the service at any time, including feature scope, integrations, pricing, or availability.

We do not guarantee uninterrupted availability. Maintenance, infrastructure issues, security events, or dependency failures may affect access.

17. Governing Law (France/EU)

These terms are governed by French law, without prejudice to any mandatory consumer protection rules that may apply in your country of residence within the European Union.

18. Dispute Resolution

We encourage you to contact us first to seek an informal resolution. If a dispute cannot be resolved amicably, it may be brought before the competent courts as determined by applicable law.

Consumers in the EU may also have access to mediation or other statutory dispute-resolution mechanisms where available.

19. Corrections

There may occasionally be information on the service that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct such issues and to update information where appropriate.

20. Disclaimer

Nothing in this section limits any mandatory rights you may have under applicable consumer law.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. EXCEPT FOR MANDATORY LEGAL WARRANTIES THAT CANNOT BE EXCLUDED, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH EVERY DEVICE, GAME, OR THIRD-PARTY PLATFORM.

21. Limitations of Liability

This section applies only to the extent permitted by applicable law and does not exclude liability that cannot legally be limited.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBLIVARK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. TO THE EXTENT A LIMIT OF LIABILITY IS LAWFUL, OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE RELEVANT PAID SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, costs, and expenses arising out of your misuse of the service, your unlawful content, or your breach of these terms.

23. User Data

We maintain certain data that you transmit to the service for operational purposes. Although we take reasonable measures to safeguard data, you remain responsible for the legality and backup strategy of content you manage through the platform.

24. Electronic Communications

By using the service and contacting us electronically, you consent to receive electronic communications from us related to your account, billing, security, updates, and support, where permitted by law.

25. Miscellaneous

These terms, together with policies expressly referenced in them, form the agreement between you and Oblivark regarding the service.

  • If one provision is found unenforceable, the remaining provisions remain in effect.
  • Our failure to enforce a provision is not a waiver of that provision.
  • You may not assign your rights or obligations under these terms without our prior consent where required.
